Abstract
Society is governed by many ties based on family and tribal ties, followed by other ties governed by common interest in its broad and narrow sense, but these ties may constitute an obstacle to achieving the principle of social justice and the rule of law.
We find that some of those who hold public positions or jobs aim to achieve their personal interest or the interests of their relatives at the expense of the public interest, which is called the term "conflict of interest", which in turn leads to several behaviors, including bias and favoritism for parties at the expense of other parties due to kinship, or obtaining undue amounts in exchange for unjustified privileges.
This prompted the Algerian legislator to adopt several measures that would prevent these phenomena, such as the phenomena of "conflict of interest and favoritism", starting with the constitutional consecration to guarantee rights and freedoms, which were translated into preventive measures included in the legislation, as well as monitoring repressive measures to confront them, such as administrative penalties and criminal penalties.
